Terms & Conditions
1. Definitions
1.1 In these Terms and Conditions, the following terms have the following meanings:
- ‘General Terms and Conditions,’ the terms and conditions of The Fun Group; The Fun Group consists of: Starboard Boats B.V., We Are Amsterdam B.V., and Red Light Workshop B.V.
- ‘Event,’ a private or public event where an activity of a touristic nature occurs, including excursions, museum visits, concerts, or sports events.
- ‘Location,’ the place where the event takes place.
- ‘Organizer,’ the party responsible for the production and/or organization of the event.
- ‘Agreement,’ the agreement between The Fun Group and the consumer for the sale and delivery of tickets.
- ‘Tickets,’ proof of access to an event.
2. Applicability
2.1 These general terms and conditions and the conditions of booking with The Fun Group apply to all offers, orders, and agreements of The Fun Group.
2.2 Additionally, the terms of the organizer and the party responsible for the location also apply. In case of conflict, these terms will prevail. Copies of these terms are available on request.
2.3 By purchasing or ordering a product, the buyer agrees to these terms.
2.4 Deviations from these terms are only available in writing, in which case other terms remain applicable.
2.5 All rights and claims stipulated for The Fun Group in these terms apply to intermediaries and third parties engaged by The Fun Group.
3. Prices/Offers
3.1 All offers by The Fun Group are non-binding, and The Fun Group reserves the right to change prices.
3.2 Prices are in euros, including VAT.
3.3 Promotional prices are valid during a specified period while supplies last and cannot be applied outside this period.
3.4 The Fun Group is not bound by incorrect prices due to typographical or printing errors.
3.5 Service fees may be charged for ticket sales, varying by event.
4. Cancellations and Returns
4.1 The organizer may cancel or change the event date. If this happens, The Fun Group will seek a reasonable solution. If an event is canceled or postponed, The Fun Group will try to inform you as soon as possible but cannot guarantee timely notification. The Fun Group is not responsible for refunds of travel, accommodation, or other related costs.
4.2 Before confirming your booking, ensure you have the correct tickets. Tickets for specific dates and times are non-refundable. Check the operator’s website for cancellation policies. Open tickets (no specific date/time) ordered online can be refunded within a month of purchase by emailing finance@weareamsterdam.com. Tickets bought from third parties or shops are non-refundable.
4.3 The Fun Group is not liable for damage, misuse, or loss of tickets. No duplicate tickets will be issued.
4.4 The Fun Group is not liable for delays, non-delivery, or incorrect delivery of tickets.
4.5 Unused pre-purchased tickets are at the buyer's risk.
4.6 Open tickets are valid for 1 year from the purchase date.
4.7 A fee is charged for rescheduling an excursion, attraction, cruise, or museum visit.
5. Payments
The Fun Group accepts various payment methods. Payments in euros must be made via iDEAL, credit card, or bank transfer. Booking is confirmed upon payment.
6. Delivery
6.1 Tickets are delivered to the address in The Fun Group’s database.
6.2 Delivery times are indicative. Failure to meet delivery times does not entitle you to compensation or order cancellation, except if non-compliance is severe.
7. Retention of Title
Ownership of delivered tickets transfers only after fulfilling all obligations to The Fun Group. Risk transfers at delivery.
8. Complaints and Liability
8.1 Check tickets upon delivery for compliance. Inform The Fun Group within three days if tickets do not comply.
8.2 If tickets do not comply, The Fun Group may replace them or refund the amount paid.
8.3 Unresolved complaints about digital products can be discussed for resolution.
9. Electronic Communication and Evidence
9.1 The Fun Group is not responsible for communication issues due to the internet or other communication tools.
9.2 The Fun Group’s data serves as proof of the agreement's existence, content, and execution.
10. Force Majeure
10.1 In the event of force majeure, The Fun Group may suspend or cancel the order without liability. Force majeure includes any failure not attributable to The Fun Group.
11. Special Provisions, Liability
11.1 Ticket buyers must act orderly and follow the event organizer's and authorities' instructions.
11.2 The Fun Group is not liable for organizer or government refusal to admit a ticket holder.
11.3 Attendance is at the ticket holder's risk. The Fun Group is not liable for any damage incurred.
11.4 Ticket holders must inform themselves of event instructions. The Fun Group is not obliged to provide additional information.
11.5 The Fun Group is not liable for non-organized activities/events.
11.6 If The Fun Group is liable, compensation will not exceed the amount paid for the order.
12. Other Provisions
12.1 If any provision in these terms conflicts with applicable law, the provision will be replaced by a lawful provision determined by The Fun Group.
12.2 Dutch law applies to all agreements with The Fun Group. Disputes will be settled by the Amsterdam court.
